What Happens If a Landlord Does Not Have a Gas Safety Certificate?

A Gas Safety Certificate — or more precisely, a gas safety record — is not a bureaucratic nicety. It is the documentary evidence that a Gas Safe registered engineer has inspected every gas appliance in your property and declared it safe to use. Without it, you are operating a rental property that may be dangerous to its occupants, and you are committing a criminal offence.

The Gas Safety (Installation and Use) Regulations 1998 set out clearly that landlords must arrange an annual gas safety check and provide the resulting record to tenants. This is enforced by the Health and Safety Executive (HSE), which takes prosecutions seriously.

Immediate Practical Consequences

You Cannot Legally Let the Property

Without a current Gas Safety Certificate, you cannot legally let a property that has gas appliances. If a tenant is already in residence, you are in breach of your legal obligations every day the certificate is expired.

Your Tenancy Notices Are Unenforceable

  • Unlimited fines and up to 2 years imprisonment on conviction on indictment (in the most serious cases)
  • Manslaughter charges if a tenant is injured or killed as a result of a gas safety failure caused by your neglect

  • Make a complaint to the PRS Ombudsman — once the Renters' Rights Act takes full effect
